AAAZ Calls for Stronger Constitutional Compliance and Institutional Accountability

AAAZ welcomes the Constitutional Court ruling concerning the Office of the Auditor-General as an opportunity to strengthen constitutional compliance, institutional accountability and public confidence in Zambia's governance systems.

The Alliance for Accountability Advocates Zambia (AAAZ) welcomes the recent Constitutional Court ruling concerning the Office of the Auditor-General as an important opportunity to strengthen constitutional compliance, institutional accountability and public confidence in Zambia's governance systems.

The ruling follows a legal challenge concerning the continued occupation of the Office of the Auditor-General by Dr. Ron Mwambwa, who had been serving in the position after attaining the constitutionally prescribed retirement age. On 21st August 2026, the Constitutional Court ruled that Dr. Mwambwa's continued occupation of the office, including in an acting capacity, was unconstitutional, null and void, and ordered him to immediately cease performing the functions of Auditor-General and vacate the office.

The matter was brought before the Court by the Law Association of Zambia (LAZ), which challenged the legality of his continued stay in office beyond the mandatory retirement age provided for under the Constitution.

The Court did not grant the request for Dr. Mwambwa to refund salaries, allowances and other emoluments received during the period, following its determination on the matter.

The decision serves as a timely reminder that strong public institutions are built on respect for the Constitution and the laws that govern public office. It also presents an opportunity for relevant authorities to reflect on existing systems and take practical steps to prevent similar situations from arising in the future.

Clarifying the implications

While respecting the decision of the Constitutional Court, AAAZ calls on the relevant Government and constitutional authorities to provide appropriate clarity on the legal and administrative implications arising from the period during which Dr. Ron Mwambwa continued to occupy and perform the functions of the Office of the Auditor-General.

The public has a legitimate interest in understanding the consequences and implications of the Court's decision, particularly considering the critical role that the Office of the Auditor-General plays in promoting transparency, accountability and the prudent management of public resources.

AAAZ therefore calls on the relevant authorities to communicate clearly on any legal, administrative or institutional matters arising from the ruling in order to promote public understanding and maintain confidence in the country's public accountability systems.

Beyond the immediate matter, AAAZ believes this ruling provides important lessons for the management of constitutional and public offices in Zambia.

Strengthening compliance going forward

Going forward, the President and all relevant bodies responsible for recommending, appointing and overseeing public officers should ensure that individuals appointed to public and constitutional offices clearly understand the constitutional and legal provisions governing their appointment, tenure and vacation of office.

Government should also strengthen guidance and awareness among civil servants and public officers regarding the laws, regulations and conditions governing their service, including mandatory retirement provisions where applicable.

Where the law provides for an office holder to retire upon attaining a specified age, the necessary processes must be followed to ensure that the office is vacated accordingly.

AAAZ Position

Public officers should not have to wait for court action or for another individual or institution to challenge their continued stay in office before complying with clear constitutional and legal requirements.

AAAZ believes that proactive compliance is essential to strengthening public institutions. Those entrusted with public office, together with the institutions responsible for appointments and oversight, must take responsibility for understanding and upholding the provisions governing public service.

Building stronger institutions

As Zambia continues to strengthen its democratic and governance institutions, AAAZ encourages all relevant authorities to use this moment to reinforce systems that promote timely compliance, effective oversight and respect for the Constitution.

Strong institutions are not only strengthened when the courts intervene, but when the right systems are in place to prevent constitutional breaches before they occur.
